Anti-harassment and nondiscrimination policy (abridged)

MAI (Montréal, arts interculturels) is committed to creating a safe and inclusive environment, promoting relationships built on mutual respect, and ensuring that all employees, artists, clients, tenants, and individuals associated with MAI are free from discrimination, harassment, and fear of discrimination. The MAI undertakes to prevent and put an end to any situation of psychological or sexual harassment within its organization, including any form of discriminatory harassment.

This policy aims to ensure that harassment and discrimination are unacceptable practices that contradict the MAI’s standards. Furthermore, this policy is supplementary to all legislative requirements concerning workplace safety.

The Labor Standards Act defines psychological harassment as follows:

“Repeated vexatious conduct, whether through behaviors, words, actions, or gestures, that are hostile or unwanted and that undermine the dignity or psychological or physical integrity of the employee, resulting in a harmful work environment for the employee. For greater precision, psychological harassment includes such conduct when it manifests through sexual remarks, actions, or gestures.”

The concept of harassment must be distinguished from other situations such as interpersonal conflicts, work-related stress, difficult professional constraints, or the normal exercise of management rights (managing attendance, organising work, disciplinary measures, etc.).

BEHAVIOURS THAT MAY BE ASSOCIATED WITH PSYCHOLOGICAL HARASSMENT INCLUDE:

  • Bullying, cyberbullying;
  • Threats, isolation;
  • Offensive or defamatory remarks or gestures towards a person or their work;
  • Verbal abuse;
  • Disparagement.

BEHAVIORS THAT MAY BE ASSOCIATED WITH SEXUAL HARASSMENT INCLUDE:

Any form of unwanted attention or advances with a sexual connotation, such as:

  • Persistent solicitation,
  • Staring, physical contact,
  • Sexist insults, vulgar remarks,
  • Remarks, jokes, or images with a sexual connotation.

MAI (Montréal, arts interculturels) does not tolerate or condone any form of psychological or sexual harassment within its company, whether it is:

  • From managers towards employees;
  • Between colleagues;
  • From employees towards their superiors;
  • From any person associated with the MAI: artists,representatives, clients, suppliers, visitors, or other.

Any behaviour related to harassment may result in disciplinary measures, including dismissal.
